If needed, the applicant can be suggested to make changes and clarifications into the application in the period specified in the notification of the national or Eurasian patent office.
In particular, if it is found that the invention described in a certain paragraph of the invention formula is not protectable according to the Convention or the Patent Instruction, the applicant can be suggested to exclude the said paragraph from the formula. In this case the term of formal check is prolonged accordingly.
If the needed changes and clarifications are not made within the specified period of time or required documents are still absent, the Eurasian application is considered revoked, of which the applicant is notified.
If it is found that the invention is not a protectable object, a committee of experts make a decision not to grant a Eurasian patent.
