The substantial check of the invention is carried out by the Eurasian Patent Office after the applicant’s petition filed no later than 6 months from the date of application.
If the patent search report is published separately, the term is 6 months from the report publication.
If the petition for the substantial check of the invention hasn’t been filed during the term of six months, it can still be filed during two months after the end of the initial term if there are valid excuses for the failure to file the petition and if the additional duty has been paid.
If the petition hasn’t been filed until the term expires or the duty for the substantial check has not been received, the application is considered revoked.
In the case of international application that were filed to the Eurasian Patent Office if it is acting as a specified or chosen agency, the petition for substantial check should be filed until the term of examination of the international application at the regional level has expired.
The Eurasian Patent Office notifies the applicant of the receipt of the petition and the results of the review. The notification of the results of petition review is sent to the applicant after the positive the formal check has ended with positive result. The date when the notification is sent is considered the day the substantial check begins
